End User License Agreement (EULA)

IMPORTANT — PLEASE READ CAREFULLY. This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Meae Care ("Company," "we," "us," or "our") governing your use of the MEAE mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not download or use the App.

1. License Grant

Subject to the terms of this Agreement, Meae Care grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial health and wellness purposes as permitted by the Usage Rules in the Apple App Store Terms of Service.

The App and all content, features, functionality, trademarks, service marks, logos, and software are owned by Meae Care or its licensors and are protected by applicable intellectual property laws. This Agreement does not grant you any rights to use our trademarks or branding. All rights not expressly granted herein are reserved by Meae Care.

4. Health and Medical Disclaimer

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Health assessments provided within the App, including but not limited to PHQ-9, CAGE, CAHPS, and preventative screening tools, are for informational and self-awareness purposes only and do not constitute medical advice, diagnosis, or a substitute for professional medical evaluation. Medication tracking features are organizational tools only and are not a substitute for guidance from your licensed healthcare provider or pharmacist.

Always consult a qualified healthcare professional before making any decisions about your health, medications, or treatment. In case of a medical emergency, call your local emergency services immediately.

5. User Data and Privacy

Your use of the App is governed by our Privacy Policy, incorporated herein by reference. By using the App, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. You retain ownership of any personal health information you enter into the App. You grant Meae Care a limited license to process your data solely as necessary to provide and improve the App's services, subject to your privacy preferences within the App.

6. Third-Party Services

The App integrates with third-party services including Google Firebase, Apple Sign-In, Google Sign-In, the GSDD medication database, and OpenWeatherMap. Your use of these services is subject to those third parties' respective terms and privacy policies. Meae Care is not responsible for the practices or content of third-party services.

7. Apple App Store Terms

You acknowledge that this Agreement is between you and Meae Care only, not Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App. Meae Care, not Apple, is responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of this Agreement.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. MEAE CARE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEAE CARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MEAE CARE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

10. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the App and delete all copies. Sections 3, 4, 8, 9, 11, and 12 survive termination.

11. Governing Law

This Agreement is governed by the laws of the State of [State], United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in [County, State].
